Any person who believes she or he has been discriminated against on the basis of race, color, or national origin or on the basis of their disability, feel they were excluded from participation in, denied benefits of, or subjected to discrimination under any of its programs, service or activities as provided by Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990, may file a Title VI or ADA complaint by completing and submitting Lutheran SeniorLife’s Title VI or ADA Complaint Form. These forms and contact information are found on the Lutheran SeniorLife website at the bottom right corner and the links found below. Lutheran SeniorLife investigates complaints received no more than 180 days after the alleged incident. Lutheran SeniorLife will process complaints that are complete. Once the Compliance Officer receives the complaint, the Compliance Officer will review it and refer it to the appropriate Lutheran SeniorLife Executive Director and/or designee of the location for which the complaint was filed. The Executive Director and/or designee will provide the complainant with an acknowledgement letter informing them the complaint has been received within ten (10) business days. The Lutheran SeniorLife Executive Director and/or designee may contact the complainant to request further information. The complainant then has ten (10) business days from the date of the letter to send requested information pertinent to their case. If the Executive Director and/or designee is not contacted by the complainant or has not received the requested information, the Executive Director and/or designee can administratively close the case. The case may also be administratively closed if the complainant no longer wishes to pursue the case. Complaints will be investigated by the Executive Director and/or designee of the location within thirty (30) calendar days from the date of the original complaint. Once the complaint is investigated, the Lutheran SeniorLife Executive Director and/or designee will issue either a letter of finding if a case of discrimination was found, or a closure letter if no discrimination was found. A closure letter summarizes the allegations and states that there was not a Title VI or ADA violation and that the case will be closed. A letter of finding summarizes the allegations and the interviews regarding the alleged incident, and explains whether any disciplinary action, additional training of the staff member, or other action will occur. If the complainant wishes to appeal the decision, they have thirty (30) days after the date of the closure letter or the Letter of Finding to do so.
